Conclusions 2023 of the European Committee of Social Rights on Children, Family and Migrants

On 20 March 2024, the Council of Europe's European Committee of Social Rights produced a crucial legal assessment on social rights. The Committee's findings highlight some progress, but significant gaps and shortcomings remain in states' efforts to guarantee social rights. 
 
The conclusions adopted by the Committee concern the accepted provisions of different articles of the Revised European Social Charter belonging to the thematic group " Children families and migrants" which includes article 31 on the right to adequate housing

Imam v LB Croydon, UK Supreme Court [2023]

The Supreme Court in R (on the application of Imam) (Respondent) v London Borough of Croydon (Appellant) [2023] UKSC 45 has unanimously held that general funding pressures are not an excuse for non-compliance with a local authority's duty under s193(2) of the Housing Act 1996 to provide suitable accommodation to a homeless individual.

Fondation Abbé Pierre and FEANTSA published their 8th annual Overview of Housing Exclusion in Europe. This report reveals new estimates of the number of homeless people in Europe and draw a specific focus to the issue of unfit housing.

State of Housing Rights

 
The Right to housing is constitutionally guaranteed in Art. 23§3 which ensures that “everyone has the right to enjoy a life in conformity with human dignity”. The right to decent accommodation is understood as part of this right to dignity. Indeed, Art. 23§3 continues by stating that “towards this end, the law, the decree or rules established under Art. 134 guarantees, taking into account the corresponding obligations, economic, social, and cultural rights of which they determine the conditions for their implementation”.
