Camara v. Belgium (Application no. 49255/22) [31.10.2022]

Date of the decision: 31 October 2022

Country: Belgium

Article: Rule 39 of the rules of the Court. Interim Measures

Jurisdiction: European Court of Human Rights

Subject:

On 31 October 2022, the European Court of Human Rights (ECtHR) granted an interim measure in the case of Camara v. Belgium (application no. 49255/22), under Rule 39 of the Rules of Court. The case concerned a Guinean national who had not received accommodation from the Federal Agency for the Reception of Asylum-Seekers (Fedasil) since his application for international protection, due to the alleged saturation of the reception centres for asylum seekers in Belgium. The domestic courts had already ordered Fedasil to house the applicant in a reception centre, or else in a hotel or any other suitable facility, but this had not been enforced so far.

The ECtHR decided that Belgium must comply with the order made by the Brussels Labour Court and must provide the applicant with accommodation and material assistance to meet his basic needs.
